1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Growth Capital Direct website, application form, and SMS / text messaging program (collectively, the "Services") operated by Growth Capital Group LLC d/b/a Growth Capital Direct. By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
2. Eligibility
You must be at least 18 years old and a resident of the United States to use the Services. By using the Services you represent that you meet these requirements and that any information you provide is accurate.
3. SMS Messaging Program Terms
By providing your mobile number and checking the SMS consent box on our application form, you expressly consent to receive recurring SMS / text messages from Growth Capital Direct related to your inquiry, account, application follow-ups, account updates, and additional financing options that may be available to you.
Program Name: Growth Capital Direct SMS Program.
Message Frequency: Message frequency varies based on your activity and account status.
Costs: Message and data rates may apply. Check with your wireless carrier.
Help: Reply HELP at any time to receive help, or contact connect@growthcapitaldirect.com.
Opt-Out: You may cancel at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, QUIT, REVOKE, OPTOUT, or STOPALL to any message you receive. After you reply STOP, you will receive one final confirmation message that you have been unsubscribed and will receive no further messages from this number.
Carriers: Carriers, including but not limited to T-Mobile, AT&T, and Verizon, are not liable for delayed or undelivered messages.
Consent Not Required: Consent to receive SMS messages is not a condition of any purchase, application, or service. You can apply or interact with our services without opting in to SMS.

4. No Guarantee of Funding
Submitting an application or inquiry does not guarantee approval, funding, or any specific terms. Approval, amounts, rates, fees, and timing are determined by individual funding providers and depend on the applicant's qualifications. Growth Capital Direct provides intake, support, and referral services and does not directly issue loans.
5. Permitted Use
You agree not to use the Services for any unlawful purpose, to misrepresent your identity, to interfere with the operation of the Services, or to attempt to gain unauthorized access to our systems.
6. Intellectual Property
All content on the website, including logos, text, graphics, and code, is the property of Growth Capital Direct or its licensors and is protected by intellectual property laws. You may not copy, distribute, or create derivative works without our written permission.
7. Privacy
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Disclaimers

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any disputes shall be resolved in the state or federal courts located in Palm Beach County, Florida.
